Terms and Conditions for membership



Parties

These general terms and conditions govern the membership of Matinique Club, a bonus point program administered by Matinique, a division of IC Companys A/S, Raffinaderivej 10, 2300 København S (referred to herein as "Matinique" or "we"). The terms and conditions apply to the relationship between Matinique and you.

Only individuals (physical persons) can obtain membership of Matinique Club.


Membership of Matinique Club

An application form may be obtained in any of the Matinique shops listed on the www.matinique.com/Footer/ClubCard website. To become a member of Matinique Club, you need to fill in the application form and return it in a Matinique Shop or send it to the address provided below. Alternatively, after picking up the application form, you can sign up for Matinique Club membership via the www.matinique.com/Footer/ClubCard website.

After becoming a member of Matinique Club you will receive a Matinique ClubCard which must be used and presented in order to collect bonus points. You can collect bonus points in the Matinique shops listed on the www.matinique.com/Footer/ClubCard website. The Matinique ClubCard is personal. Thus, bonus points may only be collected via the card in relation to purchases made by the member registered with Matinique as the owner of the card.


Collecting bonus points

For each purchase you make of Matinique products in a Matinique Shop (as defined above), a bonus amount of at least 2% of the sales price of the goods is calculated. On special occasions or selected products, an increased bonus amount of up to 10% of the sales price is calculated. For each purchase a bonus amount is calculated and converted to bonus points. The bonus points are added to your personal Matinique Club account (referred to herein as "Club account"). Example: If you make a purchase of DKK 100, a bonus amount of 2 DKK (2 %) is calculated. This amount of DKK 2 is converted into 200 bonus points which are added to your Club account. A calculated bonus amount of DKK 1 is equivalent to 100 bonus points (=1:100).

It is also possible to collect bonus points when you purchase articles of InWear products if presenting your Matinique ClubCard in one of the InWear shops/combined Matinique/InWear shops listed on the www.matinique.com/Footer/ClubCard. However, multiple-point campaigns and additional benefits might be limited to Matinique products.

If you return a purchase in accordance with the applicable return policy in the shop where you purchased the article, the bonus points collected in relation to that specific purchase will be deducted from your Club account. Irrespective of the return policy the amount of the purchase paid with the bonus cheque can not be paid out in cash.

After a period of 24 months without transactions on your Club account, the account will be deleted including any remaining points and the membership will be considered to have been terminated by you.


Using bonus points

You may only use the bonus points earned on your Club account when the total number of bonus points on the account exceeds 10,000 or more.

After you have reached the level of 10,000 bonus points on your Club account, you will within reasonable time receive a bonus cheque for purchase of Matinique goods for 100 DKK. The bonus cheque will be sent to the address given by you. Once the bonus cheque is issued, the 10,000 bonus points will be deducted from your Club account.

The bonus cheque can be used like cash payment for your next purchase in the Danish Matinique Shops (as defined above). The bonus cheque is personal and only valid for use against presentation of your Matinique ClubCard.

You can also use your bonus cheque on purchases of InWear products if presenting your Matinique ClubCard in one of the InWear shops/combined Matinique/InWear shops in Denmark listed on the www.matinique.com/Footer/ClubCard.

The bonus cheque cannot be paid out in cash.

The bonus cheque is valid for a period of 2 years from the date of issue. Please note that we will not replace the cheque if you lose it.


Personal data

In connection with Matinique Club we may record and process the following personal data pertaining to you (the "Personal Data"): i) The information provided by you when signing up for Matinique Club; ii) the bonus point movements on your Club account; iii) data about the purchases in relation to which you use your Matinique ClubCard to collect bonus points; and iv) any other insensitive data you may voluntarily provide to Matinique about yourself on the www.matinique.com/Footer/ClubCard website or otherwise in connection with your membership of Matinique Club.

We process the personal data for the purpose of administration of Matinique Club, including administration of your Club account. In addition we use the personal data for general market research, including customer analyses and segmentation, relating to the Matinique brand and other brands owned by IC Companys A/S. If you have consented to receiving marketing materials we will further use the personal data about you for purposes of forwarding of such marketing materials regarding Matinique clothes and accessories, other Matinique product lines and Matinique stores and regarding IC Company A/S's other brands' clothes and accessories, other product lines and stores.

Matinique will not disclose the personal data to any third party, however Matinique will use a third party company for processing of the personal data on Matinique's behalf.

When signing up for Matinique Club you will be assigned a personal login and password. Using your personal login and password you may via the www. matinique.com/Footer/ClubCard website at any time access the Personal Data we have stored about you. You will be able to see how many bonus points you have collected on your Club account. Via the website you may also update some of the Personal Data, e.g. in the event of address changes.


Marketing material

If you have consented to receiving E-Mail and/or SMS and/or ordinary mail containing marketing material, you will receive such E-Mails/SMS/mail at the E-Mail address/mobile number/address provided by you. You may at any time withdraw your consent by contacting ClubService per E-Mail or mail.


Termination

You may at any time terminate the membership of Matinique Club, by E-Mail or mail to ClubService (see below). Upon such termination any bonus points on your Club account at the time of termination will be cancelled. If you have 10,000 bonus points or more on your Club account at the day of cancellation, a bonus cheque will be issued. Bonus cheques that have already been issued will remain valid.

Any breach of the membership by you shall entitle Matinique to cancel the membership agreement immediately. Upon such cancellation, any bonus points earned by you will be cancelled and already issued but not used bonus cheques will become invalid.

At any time, Matinique is entitled to terminate the membership agreement with three months' notice by E-Mail or mail to the E-Mail address/mailing address recorded by you with Matinique. If the bonus points on your Club account exceed 5,000 at the effective date of the termination, a bonus cheque will be issued and sent to you for purchase of Matinique and/or InWear products for an amount equivalent to the amount of bonus point on your Club account.
