Companys Club
Terms and Conditions for membership



Parties

These general terms and conditions govern the membership of Companys Club, a bonus point program administered by Companys, a division of IC Companys A/S, Raffinaderivej 10, 2300 København S (referred to herein as "Companys" or "we"). The terms and conditions apply to the relationship between Companys and you.

Only individuals (physical persons) can obtain membership of Companys Club.


Membership of Companys Club

You can sign up for Companys Club membership via this Club Site in any of the Companys Shops listed on this Club Site.

After becoming a member of Companys Club you will receive a Companys Club Card which must be used and presented in order to collect bonus points. The Companys Club Card is personal. Thus, bonus points may only be collected via the card in relation to purchases made by the member registered with Companys as the owner of the card.


Collecting bonus points

For each purchase you make in any of the Companys Shops, a bonus amount of at least 10% of the sales price of the goods is calculated. On special occasions or selected products, an increased bonus amount of up to 20% of the sales price is calculated.

The calculated bonus amounts are converted to bonus points, with 1 DKK being equivalent to 10 bonus point. The bonus points are added to your personal Club account.

Example: If you make a purchase of 100 DKK, a bonus amount of 10 DKK (10 %) is calculated and this amount is converted into 100 bonus points which are added to your Companys Club account (referred to herein as "Club account").

If you return a purchase in accordance with the applicable return policy the bonus points collected in relation to that specific purchase will be deducted from your Club account. Irrespective of the return policy the amount of the purchase paid with the bonus cheque can not be paid out in cash.

After a period of 24 months without transactions on your Club account, the account will be deleted including any remaining points and the membership will be considered to have been terminated by you.


Using bonus points

Basic member

You may only use the bonus points earned on your Club account when the total number of bonus points on the account exceeds 4,000.

After you have reached the level of 4,000 bonus points on your Club account, you will within reasonable time receive a bonus cheque for purchase of goods in any of the Companys Shops listed on this Club Site for 400 DKK. The bonus cheque will be sent to the address given by you. Once the bonus cheque is issued, the 4,000 bonus points will be deducted from your Club account.

STAR member

If you have earned 12,000 bonus points on your Club account within a 2 year period, you will advance to STAR member. With the advancement to the star member level new terms apply:
  • The bonus cheque will increase to 500 DKK - every time your Club account reaches the level of 4000 bonus points.
  • Regular information about special offers and member activities
  • Invitation to PRE-SALE
  • Events ONLY for STAR members
In order to keep the Star member level - you have to continuously keep the level of bonus points at 12,000 points during a 2 year period. If the bonus points decrease and are below 12,000 points during the mentioned period - you will return to the basic member level and the terms which apply to this level.

PLEASE NOTE
As a Club member you earn bonus points on all goods, even though the goods are purchased on SALE or at a normal retail price. You also earn bonus points on goods paid with a bonus cheque.

The bonus cheque can be used like cash payment for your next purchase in the Danish Companys Shops. The bonus cheque is personal and only valid for use against presentation of your Companys Club card.

The bonus cheque can be paid out in cash. If you want a cash payment of the bonus cheque please sign it and return it to Companys Club, Raffinaderivej 10, 2300 København S. Remember to state your registration and account number. We will transfer the amount to your bank account.

The bonus cheque is valid for a period of 2 year from the date of issue. Please note that we will not replace the cheque if you lose it.


Personal data

In connection with Companys Club we may record and process the following personal data pertaining to you (the "Personal Data"): i) The information provided by you when signing up for Companys Club; ii) the bonus point movements on your Club account; iii) data about the purchases in relation to which you use your Companys Club Card to collect bonus points; and iv) any other insensitive data you may voluntarily provide to Companys about yourself on this Club Site or otherwise in connection with your membership of Companys Club.

We process the personal data for the purpose of administration of Companys Club, including administration of your Club account. In addition we use the personal data for general market research, including customer analyses and segmentation. If you have consented to receiving marketing materials we will further use the personal data about you for purposes of forwarding of such marketing materials regarding the clothes, accessories, other product lines in the Companys' stores and regarding IC Company A/S's other brands' clothes and accessories, other product lines and stores.

You always have the right to retract any authorization you may have given to us to process and use your Personal Data for market research and marketing purposes, by notifying ClubService by mail or email.

Companys will not disclose the personal data to any third party, however Companys will use a third party company for processing of the personal data on Companys's behalf.

When signing up for Companys Club you will be assigned a personal login and password. Using your personal login and password you may via this Club Site at any time access the Personal Data we have stored about you. Via this Club Site you may also update some of the Personal Data, e.g. in the event of address changes. You will also be able to see how many bonus points you have collected on your Club account.


Marketing material

If you have consented to receiving email and/or SMS and/or ordinary mail containing marketing material, you will receive such emails/SMS/mail at the email address/mobile number/address provided by you. You may at any time withdraw your consent by contacting Club Service per email or mail.


Termination

You may at any time terminate the membership of Companys Club, by email or mail to Club Service. Upon such termination any bonus points on your Club account at the time of termination will be cancelled. If you have 4,000 bonus points on your Club account at the day of cancellation, a bonus cheque will be issued. Bonus cheques that have already been issued will remain valid.

Any breach of the membership by you shall entitle Companys to cancel the membership agreement immediately. Upon such cancellation, any bonus points earned by you will be cancelled and already issued but not used bonus cheques will become invalid.

At any time, Companys is entitled to terminate the membership agreement with three months' notice by email or mail to the email address/mailing address recorded by you with Companys. If the bonus points on your Club account exceed 2,000 at the effective date of the termination, a bonus cheque for purchase of goods in any of the Companys Shops listed on this Club Site will be issued and sent to you.
